About these terms

These terms apply when you use EasyPalmCards: the website at easypalmcards.com, the EasyPalmCards apps and the embeddable card player. EasyPalmCards is run by Easy Palm Cards, a registered Australian business (“we”, “us”).

By using EasyPalmCards you agree to these terms and to our Privacy Policy. If you use EasyPalmCards for a school or organisation, you confirm you may accept these terms for it. Nothing in these terms takes away rights you have under consumer laws that cannot be excluded, including the Australian Consumer Law.

Accounts

• You can use much of EasyPalmCards without an account. An account is needed to save sets to a library, join or run a class, and buy Gold.
• Give accurate details, keep your sign-in secure and tell us if you think someone else has used your account. You are responsible for what happens in your account.
• If you are under 16, or under the age your country sets for agreeing to online services, you need a parent's or guardian's permission, or to use EasyPalmCards through your school.
• One person per account. Accounts can't be sold or transferred.

The free plan

The free plan lets you split, edit, print, export, present, rehearse and study cards, with daily and monthly limits on some features (for example PDFs and AI actions). The current limits are shown in the app and on the pricing page. The free plan is supported by ads on some pages. We may change what the free plan includes, and will try to give notice of significant changes.

Gold plans and payments

EasyPalmCards Gold adds features such as a saved library, lasting share links, full PDFs, more AI actions, rehearsal history, synced study progress and no ads. What each plan includes and costs is shown on the pricing page and at checkout. Gold is sold as:

• Monthly and yearly subscriptions, which renew automatically at the end of each period until you cancel.
• Student yearly, a yearly subscription for students at a school, college or university. We may ask for proof you are a student, and move you to the standard yearly price at your next renewal if you aren't.
• 7-day and 30-day passes, one payment for that many days of Gold. Passes don't renew. A new pass adds its days to any pass you already have.
• Lifetime, one payment for Gold for as long as your account exists and we operate EasyPalmCards. It doesn't cancel a subscription you already have, so cancel that yourself to avoid being charged again.

Payments are processed by Stripe. Prices are shown in your currency where we offer it and include tax where the law requires (for example GST in Australia); some taxes are added at checkout based on your billing address. If we change a subscription price, we will tell you before it applies to your next renewal, and you can cancel before then. Promotion codes, referral rewards and account credit can't be exchanged for cash.

Gold bought in the EasyPalmCards mobile app through Apple or Google is billed and refunded by them under their terms.

Free trial

New Gold members can have one 7-day free trial per account. No payment method is needed to start it. If you add a payment method before the trial ends, your subscription continues at the price shown when you started; if you don't, Gold simply switches off at the end of the trial and you are not charged.

Cancelling

You can cancel a subscription at any time in Manage plan on your account. It then won't renew, and you keep Gold until the end of the period you have paid for. When Gold ends, your saved sets are kept and stay yours, and features that need Gold stop.

Refunds and your consumer rights

• Cancelling stops future payments but doesn't refund the current period, except as set out below or where the law requires.
• If something went wrong, for example you were charged by mistake or Gold didn't work for you, email [email protected] and we will look at it fairly. A full refund ends the Gold that payment paid for.
• If you live in the European Union or the United Kingdom, you can cancel a subscription or pass within 14 days of buying it and get a full refund by emailing us.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Classroom plan

Teachers can run one free class with limits on students and sets. The Classroom plan is a yearly subscription that allows more classes, students and sets and includes Gold for the teacher; the current limits are on the teachers page. Students in a paid class get synced study progress and no ads while they are in it.

Teachers are responsible for having the permissions their school and, where needed, parents require before inviting students, and for the sets they assign. Students don't need to pay to join a class.

AI features and fair use

• AI features have monthly and daily allowances, shown in the app. Unused actions don't carry over. An action that fails is given back.
• AI can be wrong, incomplete or unoriginal. Check what it writes before you rely on it, present it or hand it in, and follow your school's rules on using AI.
• Storage, PDFs, uploads and other features have fair-use limits to keep EasyPalmCards fast and affordable. We may slow or limit use that is far beyond normal personal or classroom use or that harms the service.

Your content

Your cards, notes, images and imported files stay yours. You give us permission to store, process, display and copy them only as needed to run EasyPalmCards for you: saving and syncing them, making PDFs and previews, checking images for safety, sending text to AI features you use, and showing them to people you share them with. This permission ends when you delete the content, except for copies we must keep by law or that others already made through Duplicate & edit.

You are responsible for having the right to use what you put in your cards. Templates and examples we provide may be used and adapted for your own talks, study and teaching.

Acceptable use

Don't use EasyPalmCards to:

• break the law, or share content that is illegal, sexual content involving minors, hateful, harassing, threatening or that shows graphic violence;
• infringe other people's copyright, privacy or other rights;
• upload malware, attack, probe or overload the service, or get around limits, security or payments;
• scrape or copy the service, or resell it, without our written permission;
• impersonate others, or mislead people with share links or embeds;
• cheat in exams or assessments where using notes or AI is not allowed.

Sharing, embeds and reports

Anyone with a share link can view that set, copy it with Duplicate & edit, and see it in any embed. Only share what you are happy for others to see. Without Gold, a share link lasts 7 days. Anyone can report a shared set. We may hide a set or image from public view, or remove it, if we believe it breaks these terms, and we check uploaded images automatically before they can be shared.

Our service

We work to keep EasyPalmCards available and your work safe, but we can't promise it will always be uninterrupted or error-free. Keep your own copies of anything important; you can export sets as PDF, Word, PowerPoint, text, CSV or Anki at any time. We may change, add or remove features. If we ever stop running EasyPalmCards, we will give at least 60 days' notice so you can export your work, and refund the unused part of any subscription or pass.

The EasyPalmCards name, logo, software and site content (apart from your content) belong to us. You may not copy them except as these terms allow.

Suspending or ending your account

You can stop using EasyPalmCards at any time and delete your account under Profile Settings. Deleting it cancels any active subscription straight away, so you are not charged again. We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Where it's reasonable we will warn you first and let you export your sets. If we close your account without good reason under these terms, we will refund the unused part of any paid Gold.

Liability

To the extent the law allows, and apart from the consumer guarantees above, EasyPalmCards is provided “as is”. We are not liable for indirect or consequential loss, or for losses caused by content you or other users create, AI results you rely on, or things outside our reasonable control. Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to supplying the service again or paying the cost of having it supplied again. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

Law and disputes

These terms are governed by the law of Queensland, Australia. If you have a problem, please email us first; most issues can be fixed quickly. Courts in Queensland can hear disputes, but if you are a consumer living in another country you keep the protection of its mandatory laws and can also bring a claim in your local courts.

Changes to these terms

We may update these terms as EasyPalmCards changes. We will change the “Last updated” date and, for significant changes, tell signed-in users in the app at least 14 days before they apply. Changes don't apply to a period you have already paid for in a way that reduces what you bought.
